Electoral practice recognises that candidates often go by names other than their given first name - names are shortened or anglicised, some people use their middle name as their first name, some are known generally by a nickname and so on. For this reason a common practice is to require candidates to use their correct legal surname (which can be changed by deed poll) but to allow them to use whatever form(s) of their first name they like (within reason). This is subject to limitations on names considered likely to interfere with the electoral process, eg Informal. Defeat on the councillor ballot does not prevent a person from "winning" the LM/DLM election, it just prevents them from accepting the position if elected. So the Councillor election has no impact on the order of exclusions for LM/DLM.<br /><br />The answer to the second question is no. The countback is a casual vacancy provision and does not change the outcome of the original election. Interesting to see why, if a candidate holds those views publicly, they would not want their views publicised - if any candidate believes their point of view has the support of a majority of HCC electors then any publicity is good publicity. As I understand it the concern was with a pro-cable-car Facebook page attempting to publish a list of candidates who supported, opposed or had some kind of open-to-the-proposal view on the cable car, without permission of some of those candidates. This could be seen to be an advertisement with the goal of procuring the election of those who supported the cable car, though I do not envy those at the TEC who have to work out whether stuff of this kind is "advertising" or not. However I haven't seen the correspondence with the page owners regarding this matter so I don't know for certain if that was the issue.<br /><br />My articles are comment, not advertising, although they do link to candidate advertising for the purposes of commentary, analysis, public information and reporting. They are not designed to support the election of any particular candidate(s) and indeed I have little idea which candidate(s) I would support even if I wanted to. <br /><br />If advised that a particular candidate wished not to be covered I would consider replacing all instances of their name with "Candidate who does not wish to be named".<br /><br />Incidentally it is my strong view that these restrictions should be repealed.
